Chapter 1 General

(Purpose)

Article 1

Article 2

(Creation, etc. of Various IDs)

Article 3

  1. Users of the System may agree to comply with these Terms of Use and may apply for the creation of various IDs provided by the System or the registration of various IDs in the System by using the methods specified by Digital Agency for each ID. In addition to the provisions of these Terms of Use, Digital Agency may determine the qualifications of persons who can be issued or registered for each ID.
  2. Digital Agency shall issue or register the applied ID only when it approves the creation or registration of various IDs by the users of the System. Notification of the completion of the creation or registration of various IDs shall be made by a method separately specified by Digital Agency depending on the nature of each ID.
  3. Digital Agency may refuse the creation or registration of various IDs in the following cases. Digital Agency is not obliged to disclose the reason except in cases based on law, etc.
    1. In the case that all or part of the information provided at the time of application is false, erroneous, or omitted
    2. In other cases where the Digital Agency deems the creation or registration to be inappropriate

(Responsibilities of System Users)

Article 4

  1. Users of the System shall use the System at their own responsibility and shall manage the services provided by the System and information related thereto, various IDs, and identification numbers linked to various IDs (hereinafter referred to as "IDs, etc.") with the due care of a prudent manager so that third parties do not know them without justifiable grounds.
  2. If an ID, etc. is used in the System, it shall be deemed to be used by the Principal who has the obligation to manage it.

(Facilities, etc. of System Users)

Article 5

  1. The environmental conditions for users of the System to use the System shall be the conditions posted by Digital Agency for each type of ID.
  2. The System User shall prepare all equipment (including all software and communication means; the same shall apply hereinafter in this Article) necessary to use various IDs to be issued or registered in the System under his / her management at his / her own expense. In addition, the procedures necessary for the preparation of the equipment shall be performed by the System User at his / her own responsibility.
  3. Communication costs necessary for using the System and any other costs related to the use of the System shall be borne by the User of the System.

(Responsibility of Digital Agency)

Article 6

  1. Digital Agency provides the System in accordance with these Terms of Use and the specifications, etc. of the System disclosed on the website managed by Tokyo University.
  2. Unless otherwise specified, even if the users of the System are bound by or restricted by the terms, conditions, specifications, agreements, etc. set forth by third parties other than Digital Agency (including other ministries and agencies and Digital Agency), local governments shall not be aware of the circumstances, and the users of the System shall use the System at their own responsibility and expense so as to cope with the said restrictions and restrictions and not to violate them.

(Intellectual Property Rights Relating to the System)

  1. (Prohibited Matters)

Article 8

  1. Users of the System shall be prohibited from engaging in any of the following acts when using the System.
    1. An act that is contrary to law or public policy
    2. Acts of illegally accessing or attempting to access the System, its servers, networks or other systems
    3. Acts of using the System by spoofs to third parties other than the Principal (including acts of stealing or defrauding third parties of their authority to acquire points)
    4. Acts that violate copyrights, trademark rights, or other intellectual property rights contained in the System
    5. Damaging the credibility of the System or interfering with the operation of the System by spreading rumors or using fraudulent means or force
    6. Destruction or interference of the functions of the servers or networks of the System or any other act having an adverse effect on the System
    7. Analysis, falsification, duplication, or secondary use of systems, software, protocols, etc. related to the System through reverse engineering, etc.
    8. Conduct that interferes with or is likely to interfere with the operation of the System
  2. Digital Agency may suspend the use of the System without prior notice if any of the Users of the System has committed or is likely to commit any of the acts listed in the items of the preceding paragraph.

(Available Time and Suspension of Use)

Article 9

  1. As a general rule, the system is available for use 24 hours a day, 365 days a year; provided, however, that Digital Agency is only obligated to make efforts to use the system during the available time, and does not guarantee that the system will be used.
  2. Notwithstanding the provisions of the preceding paragraph, this system may not be used due to operating conditions of the server, significant concentration of use, etc.
  3. If any of the following items is deemed to apply, Digital Agency may suspend the use of the System by posting the relevant information on the System in advance; provided, however, that in case of urgent necessity, the University may suspend the use of the System without posting the relevant information on the System.
    1. When maintenance of equipment, etc. is scheduled

(Termination of the System)

Article 10

Digital Agency may terminate the operation of the System by announcing or notifying the Users of the System no later than three (3) months prior to the termination date; provided, however, that in case of urgent necessity, prior announcement or notification shall not be required.

(Damages, etc.)

Article 11

  1. Digital Agency shall not be liable for any damages suffered by users of the System in connection with the System or these Terms of Use, unless such damages are caused by willful misconduct or gross negligence on the part of Digital Agency; provided, however, that if the legal relationship between Digital Agency and a Private User falls under the category of a consumer contract under the Consumer Contract Act, Digital Agency shall be liable for any damages suffered by a Private User arising from Digital Agency's negligence (excluding gross negligence) to the extent of normal and direct damages actually caused to the Private User.
  2. Notwithstanding the preceding paragraph, the public authorities shall not be liable for the users of the Digital Agency, etc. and the users of the Business Operator unless it is due to the willful misconduct or gross negligence of the Digital Agency.

(Revision of the Terms of Use)

Article 12

  1. Digital Agency may amend these Terms of Use if the amendment to the Terms of Use conforms to the general interests of the users of the System or is reasonable in light of the necessity of the amendment, the appropriateness of the content after the amendment, or any other circumstances pertaining to the amendment.
  2. When Digital Agency intends to amend these Terms of Use, except in urgent cases, it shall announce on the System or the Digital Agency Website that it will amend these Terms of Use, the content of the amended Terms of Use, and the effective date of the amendment no later than seven (7) days prior to the effective date of the amendment.
  3. When a System User uses the System in after amendment under these Terms of Use, the System User is deemed to have agreed to the Terms of Use of after amendment.

(Governing Law)

Article 13

These Terms of Use shall be governed by the laws of Japan.

(Other Necessary Matters)

Article 14

In addition to the provisions of these Terms of Use, other necessary matters concerning the use of the System shall be separately determined by the State of Digital Agency.

Chapter 2 Creation, Management, etc. of My Key IDs

(Creation, etc. of My Key ID)

Article 15

  1. Individual users may apply to create a My Key ID and register it in the system by a method separately specified by the State of Digital Agency. However, multiple My Key IDs may not be created at the same time.
  2. Individual users who have created a My Key ID and registered it in this system may revoke the My Key ID at their discretion by a method separately specified by the State of Digital Agency.
    3. If the My Key ID expires (not limited to the case described in the preceding paragraph), individual users will no longer be able to use the functions of the System that use the My Key ID (including functions used through users such as public authorities).

(Matters to Be Agreed Upon the Creation, etc. of My Key ID)

Article 16

  1. Individual Users agree to the matters listed in the following items when creating, registering, and using My Key IDs (including cases where My Key IDs are used in association with Service IDs; the same shall apply hereinafter in this Article).

  1. Article 18

Chapter 4 Creation, Management, etc. of PPID

Article 19

Users of public authorities, etc. may create a PPID for services under their management that conform to the specifications separately determined by Digital Agency and apply for registration in the system.

Article 20

  1. Public authorities, etc. When a user of a service under the user's management uses the System through the PPID Use Service, the user shall obtain the consent of the user to the matters listed in the following items.

Chapter 5 Matters Related to Individual Number Card Point

Article 22

Article 26

    2. Among application support businesses, application support businesses that support application procedures for Individual Number Card Point through ATMs and multi-copy machines may connect to the system to the extent necessary for the performance of Individual Number Card Point services.

(Loss of Rights)

Article 27

  1. In the following cases, Digital Agency will cause the right to apply for Individual Number Card Point to be forfeited.
    1. When the System User has revoked his / her My Key ID
    2. In case that the System User violates these Terms
    3. Upon termination of the operation of the System
